New California-Compliant AB 1825 Harassment Prevention & Bystander Training PLUS “Train-the-Trainer”


Are You Aware of the New California Laws Regarding Harassment Prevention & Bystander Training (SB 1343 and 1300)?


Beginning January 1, 2019, California Senate Bill 1343 requires all public and private employers with five (5) or more employees to provide at least 2 hours of sexual harassment training to all supervisory employees and at least 1 hour of sexual harassment training to all nonsupervisory employees by January 1, 2020, and once every 2 years thereafter. Existing law requires the trainings to include harassment based on gender identity, gender expression, and sexual orientation and to include practical examples of such harassment and to be provided by trainers or educators with knowledge and expertise in those areas. Under the regulations, the definition of “employee” includes full-time, part-time, and temporary employees.


In accordance to guidance from the Department of Fair Employment and Housing (DFEH), the law requires that all employees be trained during calendar year 2019 (meaning, before December 31, 2019). Employees who were trained in 2018 or before will need to be retrained. In addition, all employees statewide must be retrained by January 1, 2022. The DFEH will also accept complaints from employees that their employers have not complied with the law requiring that sexual harassment prevention training be provided.


In addition, Senate Bill 1300, which also took effect January 1, 2019, authorizes employers to offer bystander intervention training that includes information and practical guidance on how to enable bystanders to recognize potentially problematic behaviors and to motivate bystanders to take action when they observe problematic behaviors.

Under applicable regulations, 2 CCR § 11024(a)(9), human resource professionals with a minimum of two or more years of practical experience in one or more of the following are qualified to serve as trainers: (a) designing or conducting discrimination, retaliation and sexual harassment prevention training; (b) responding to sexual harassment complaints or other discrimination complaints; (c) conducting investigations of sexual harassment complaints; or (d) advising employers or employees regarding discrimination, retaliation and sexual harassment prevention.
